Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nour Elmassry website and your purchase of physical and digital artworks offered through it. By placing an order or otherwise using this site, you agree to be bound by these Terms. If you do not agree, please do not use this site or place an order.

1. Order Acceptance & Fulfilment

All orders are subject to acceptance and availability. We reserve the right to limit, decline, or cancel any order at our discretion — for example, if an edition has sold out, pricing information was incorrect, or payment cannot be verified. Once payment is confirmed, you will receive an order confirmation by email. Physical artworks are prepared and dispatched as described at checkout; digital artworks are made available for download once payment is confirmed.

2. Physical Artworks

• Ownership. Title and ownership of a physical artwork transfer to you upon full payment and dispatch. Risk of loss or damage transfers upon delivery to the shipping carrier.
• Shipping. Shipping costs, carriers, and estimated delivery timeframes are presented at checkout and vary by destination. We are not responsible for delays caused by customs processing, couriers, or circumstances beyond our reasonable control.
• Delivery. You are responsible for providing an accurate shipping address. We are not liable for orders misdelivered due to incorrect address information provided at checkout.
• Authenticity. Each physical edition is produced and, where applicable, signed and numbered by the artist, and is accompanied by a certificate of authenticity confirming its edition number and provenance.

3. Digital Artworks — License Terms

When you purchase a digital artwork, you are purchasing a limited, personal, non-exclusive, non-transferable license to download and use the digital file for your own private, non-commercial enjoyment (for example, personal display on your own devices). You do not acquire ownership of the underlying artwork, copyright, or any intellectual property rights, all of which remain with the artist.

The purchased file is intended solely for the original buyer and may not be redistributed, resold, shared, copied, sublicensed, gifted, or transferred to any third party.

Specifically, and without limitation, you may not:

• Resell, rent, lease, or sublicense the digital file or any copy of it.
• Share, distribute, or transmit the digital file to any third party.
• Reproduce the digital file for distribution or publication.
• Use the digital file for any commercial purpose without our prior written permission.
• Upload the digital file to any public platform, marketplace, or NFT/minting service.
• Claim authorship, modify, or create derivative works from the digital file.

Any use beyond the scope of this license requires a separate written agreement with us. We reserve the right to revoke access to digital files and pursue remedies available under applicable copyright law in the event of a breach of this license.

4. Refund Policy

• Physical artworks. If your order arrives damaged or defective, please contact us within 7 days of delivery with photographic evidence, and we will arrange a replacement, repair, or refund as appropriate. Returns for reasons other than damage or defect are considered on a case-by-case basis and must be requested prior to shipment where possible.
• Digital artworks. Due to the nature of digital goods, once a digital artwork has been downloaded, the sale is final and non-refundable, except where required by applicable law or in cases of a technical fault preventing access to the purchased file.

5. Intellectual Property & Copyright

All artworks, images, photographs, text, and content on this site are the copyrighted property of Nour Elmassry (or licensed to us) and are protected by applicable copyright and intellectual property laws. Purchasing a physical or digital artwork does not transfer any copyright, trademark, or other intellectual property rights. No content from this site may be reproduced, copied, or used without prior written permission, except as expressly permitted under the digital license terms above.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Nour Elmassry shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site, your purchase, or your use of any artwork. Our total liability for any claim arising from an order shall not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.

7. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site, or placing an order after changes are posted, constitutes acceptance of the updated Terms.
